Declaring you are a First Nations person

Only Aboriginal and Torres Strait Islander people living in South Australia can nominate and vote in SA Voice elections. To nominate as a candidate for a Local First Nations Voice and vote in the SA First Nations Voice Election, you will need to declare you are First Nations person.

Aboriginal and Torres Strait Islander (First Nations) identity - The three-part test

The SA First Nations Voice to Parliament legislation uses the commonly used Tripartite/three-part test to establish Aboriginal and Torres Strait Islander (First Nations) identity.

Which is that the person:

  1. Is of Aboriginal or Torres Strait Islander descent; and
  2. Regards themselves as Aboriginal or Torres Strait Islander; and
  3. Is accepted as an Aboriginal or Torres Strait Islander person by the relevant Aboriginal or Torres Strait Islander community.

Providing written proof of Aboriginality is not needed. There are penalties for providing false declarations. A person who falsely declares that they are a First Nations person could be subject to a term of imprisonment for up to 4 years if found guilty.
